As soon as the certificate of seizure has been delivered by the debt collection office we inform you about the debt collection process. In most cases the income of the debtor is seized which means that all income above a determined minimum subsistence level are seized over a period of max. 12 months.
Most of the time the money is kept by the debt collection office until the end of the year and is then paid out to Cashare. The sum is then forwarded to you after the deduction of the cost of debt collection.
Is the outstanding amount fully covered the debt is terminated by that payment.
If the outstanding amount is not or not fully covered a certificate of loss is then issued. If this is the first certificate of loss issued in this case, an application for continuation can immediately be submitted again and a second period of seizure (1 year) can be requested. If in the second year the full amount is still not recovered a certificate of loss is again issued and the debt enforcement proceedings have to be freshly initiated. A new summons for payment is then delivered. Upon delivery of the summons for payment the application for continuation is again requested and the process starts anew, with the difference that a certificate of loss is already present, which means that the debt is already recognized and an objection from the debtor can easily be dismissed.
In principle, a new seizure is then simply requested year after year until the amount could be repaid. Should the income situation change over the years so that, for example, no seizure can be carried out due to insufficient subsistence level, we will be informed accordingly by the debt collection office and a loss certificate will be issued.
